Thank you to Dr Chris Parks of Halcrow for bringing to my attention the briefing note produced by the Association of Consulting Engineers (ACE), expressing its concern about the 'fit for use' requirement in the head Eurocode. Clause 2.1(1)P of EN 1990 states that:
'A structure shall be designed and executed in such a way that it will ... remain fit for the use for which it is required'
ACE is concerned that existing UK Professional Indemnity (PI) insurance policies do not cover express fitness for purpose obligations. ACE is currently discussing the matter with BSI and CEN to resolve the issue, without imposing undesirable commercial obligations on consulting engineers.
